Sec. 13.404. DUTIES OF DEPARTMENT

  • (a) The department may periodically monitor and inspect or test weighing or measuring devices that have been inspected and tested by a license holder and any standards used by the license holder during an inspection or test.

    (b) The department by rule shall adopt guidelines to allow a representative of the license holder to perform functions of the license holder.

    (c) The department by rule may adopt additional requirements for the issuance of a license and for the denial of an application for a license or renewal of a license. The rules adopted by the department shall be designed to protect the public health, safety, and welfare and the proper operation of weighing and measuring devices.

    (d) The department by rule shall adopt a fee schedule for services performed by a license holder.
