(a) Except as provided by Subsection (b), a defendant who is found not guilty by reason of insanity stands acquitted of the offense charged and may not be considered a person charged with an offense. (b) A defendant who is found not guilty by reason of insanity is not considered to be acquitted for purposes of Chapter 55. |
