Art. 46C.202. DETENTION OR RELEASE |
|
(a) Notwithstanding Article 46C.201(b), a person placed in a department facility or a facility of the Department of Aging and Disability Services pending civil hearing as described by that subsection may be detained only with the consent of the head of the facility and under an Order of Protective Custody issued under Subtitle C or D, Title 7, Health and Safety Code. (b) If the court does not detain or place the person under Article 46C.201(b), the court shall release the person. |
