Sec. 773.065. ADMINISTRATIVE PENALTY

(a) The commissioner may assess an administrative penalty against an emergency medical services provider or a course coordinator who violates this chapter or a rule adopted or an order issued under this chapter.
(b) In determining the amount of the penalty, the commissioner shall consider:
(1) the emergency medical services provider's or course coordinator's previous violations;
(2) the seriousness of the violation;
(3) any hazard to the health and safety of the public;
(4) the emergency medical services provider's or course coordinator's demonstrated good faith; and
(5) any other matter as justice may require.
(c) The penalty may not exceed $7,500 for each violation. The board by rule shall establish gradations of penalties in accordance with the relative seriousness of the violation.
(d) Each day a violation continues may be considered a separate violation.
