Sec. 352.306. DECISION BY BOARD

(a) Based on the findings of fact, conclusions of law, and proposal for decision, the commissioner of public health or the commissioner's designee by order may determine that:
(1) a violation occurred and assess an administrative penalty; or
(2) a violation did not occur.
(b) The department shall give notice of the order to the person. The notice must include:
(1) separate statements of the findings of fact and conclusions of law;
(2) the amount of any penalty assessed; and
(3) a statement of the person's right to judicial review of the order.
