Sec. 1303.106. LICENSE DENIAL: APPEAL TO COMMISSION

  • (a) To appeal the denial of a license as provided by Section 1303.354, a license applicant must file not later than the 10th day after the date of the notice of denial a written appeal requesting a hearing before the commission. If an applicant fails to request a hearing as provided by this subsection, the commission's decision is final and not subject to judicial review.

    (b) The commission shall:

    (1) set a time and place for the hearing not later than the 30th day after the date the commission receives the appeal; and

    (2) notify the applicant in writing of the scheduled hearing not later than the 10th day before the date of the scheduled hearing.

    (c) The hearing may be continued with the applicant's consent. After the hearing, the commission shall enter an appropriate order.
