Sec. 1058.106. AWARD OF CERTAIN CONTRACTS

  • (a) The board, on behalf of the district, may enter into a contract that exceeds $2,000 only with the lowest qualified bidder.

    (b) Before awarding a contract under this section, notice must be given by:

    (1) advertising in one or more newspapers of general circulation in this state, once a week for four weeks; and

    (2) posting a notice for at least 25 days at four public places in Upton County, including:

    (A) at the courthouse door; and

    (B) in at least two other places in the district.

    (c) On application by a person who wants to bid on the contract, the board shall provide to the person:

    (1) a copy of the plans and specifications; or

    (2) other data necessary to make the bid.

    (d) A bid under this section must be in writing, sealed, and delivered to the presiding officer of the board together with a certified check for at least five percent of the total amount of the bid.

    (e) If the bidder's bid is accepted but the bidder refuses a proper contract with the board, the certified check required by Subsection (d) is forfeited to the district.

    (f) The board may reject a bid under this section that the board considers too high.
