Sec. 781.351. GROUNDS FOR DISCIPLINARY ACTION

  • (a) For a violation of this chapter or a rule adopted under this chapter, the department may:

    (1) revoke or suspend the person's license or registration;

    (2) place on probation the person if the person's license or registration has been suspended; or

    (3) reprimand the license holder or registrant.

    (b) The department shall take disciplinary action described by Subsection (a) on proof:

    (1) that the applicant, license holder, or registrant has:

    (A) violated this chapter or a department rule adopted under this chapter;

    (B) been convicted of a Class B misdemeanor or equivalent offense if the fifth anniversary of the date of the conviction has occurred;

    (C) engaged in fraud, deceit, or misrepresentation; or

    (D) made a material misstatement in an application for or renewal of a license or registration; or

    (2) that the license holder of a registrant has submitted to the department sufficient evidence that the registrant:

    (A) engaged in fraud or deceit while employed by the license holder; or

    (B) committed theft while performing work as a registrant.
